NOVEMBER 16, 2023 – Andrew Kaufman recently obtained a unanimous reversal in the Appellate Division for Trinity Evangelical Lutheran Church, after the trial court denied its pre-deposition motion for summary judgment. The plaintiff slipped and fell on an alleged waxy floor condition in the portion of the church leased to her employer, which ran a pre-school. Her employer had the exclusive responsibility to clean and maintain the area. While the church had the right to reenter to inspect, it had no contractual obligation to maintain the premises.
